Terms of Service

The following includes our terms of service, some disclosures and why they’re all important. Our terms of service include ways you can use TAYGLE and also what’s not allowed.

TAYGLE helps people connect and share information and also learn about products and services offered by advertisers. With TAYGLE, people can share messages, photos, videos, information and opinions. They can showcase artistic talents like painting, sculpting, acting, singing, or playing a musical instrument. People can share announcements, plan events and make presentations. They can share opinions, photos, and videos. They can review products, services and read other people’s reviews. People can express views about world events, literature, music, art, architecture, business and politics. They can publish writings, art and music. People can sell, rent and find cars, apartments, real estate, clothing, appliances, electronics and furniture. They can offer or find employment or promote a product or service.

TAYGLE's for anyone who needs or wants an easy way to advertise their business, products, or services. It's for anyone who might not have the time or resources to create their own web page. It’s for people such as artists, babysitters, bookkeepers, detailers, construction pros, drivers, entertainers, gardeners, hair and beauty pros, health care providers, housekeepers, landlords, nannies, personal assistants, pet groomers, real estate pros, retailers, service techs, tutors, window cleaners, writers and so many, many more.

TAYGLE provides the above advantages yet you’re not required to pay for them except as stated otherwise. When you use TAYGLE’s services, you agree that TAYGLE can present advertisements, offers and promotions that you may find interesting. TAYGLE utilizes personal data of people who use TAYGLE’s services to decide what ads to present. For example, your activity and interests are data we use to personalize your ads and other content.

Protecting privacy is a very important part of TAYGLE’s process of utilizing personal data to show ads. TAYGLE does not and will not sell or share names or contact info that might specifically identify a user of TAYGLE unless you provide us permission. This is how we can show ads that we think may interest you without telling advertisers who you are.

Advertisers tell TAYGLE what kinds of people might be interested in their ads and TAYGLE gives them feedback about how people react to their ads.

Our Privacy Policy details the way we collect and utilize your personal data in determining some of the ads that are presented to you. With TAYGLE, you can review and decide on privacy settings for your data.

Our most important goal is to maintain a safe, secure and enjoyable way to use TAYGLE. We use various ways to monitor activity and help identify potential misuse of TAYGLE. We watch for conduct that might hurt users. When we become aware of misuse or harmful conduct, we review the facts and respond in a way that may include simply notifying you, offering assistance, eliminating content, eliminating or restricting access to specific features, shutting down an account, or notifying law enforcement. TAYGLE may get access, retain, use and share any information it gathers regarding you in situations where TAYGLE, in good faith, believes it’s required or permitted by law.

Under some circumstances, an appeal committee may be available to review our decisions.

We do research to improve TAYGLE services. We place content and data in locations and with service providers throughout the world in order to provide and run our global services and help you connect with people around the world.

When using TAYGLE, you agree to the following.

You are at least 13 years old.

Your TAYGLE account is in your name that you use most commonly on a day to day basis with friends, family and colleagues.

Information you provide about yourself is accurate.

You create only one account for yourself and use it for personal purposes.

You will not share your password or give access to your TAYGLE account to others.

You will not transfer your TAYGLE account to another person or entity without our permission.

You are not a convicted sex offender.

Should we need to disable your account, you may not create a new account without our permission.

You will not create an account or use TAYGLE services, products or software where and when prohibited by applicable law.

You may not upload viruses or malicious code, use TAYGLE to send spam, or do anything that could disable, overburden, interfere with, or impair the working, integrity, operation, or appearance of TAYGLE’s services, systems, or products.

You may not access or collect data from TAYGLE using automation without our permission.

You may not use TAYGLE or help others use TAYGLE in a way that violates the terms and policies of TAYGLE or that is unlawful, misleading, discriminatory or fraudulent.

You may not use TAYGLE or help others use TAYGLE to share anything in a way that violates the terms and policies of TAYGLE or that is unlawful, misleading, discriminatory or fraudulent.

You may not use TAYGLE to share anything that you do not own or have the required rights to share.

You may not use TAYGLE or help others use TAYGLE to share anything that you or those that you help do not own or have the necessary rights to share or that harms someone else’s rights, such as a copyright or trademark unless an exception or limitation applies under applicable law.

You may not use TAYGLE or help others use TAYGLE to sell or distribute counterfeit or pirated goods unless an exception or limitation applies under applicable law.

You may not sell, license, or purchase any data obtained from TAYGLE except as agreed to by us.

You may not misuse any reporting, flagging, dispute, or appeals channel, such as by making fraudulent, duplicative, or unsubstantiated report or appeals.

We can remove or restrict access to content that is in violation of these provisions. If we determine, in our discretion, that you have clearly, seriously or repeatedly breached our terms or service or our policies, including in particular the Fairness Standards, we may suspend or permanently disable your access to TAYGLE, and we may permanently disable or delete your account.

At your discretion, you will report content or conduct that you believe violates your rights or our terms and policies.

We can remove or restrict access to content, services, or information if we determine doing this is reasonably necessary to avoid or mitigate misuse of, or adverse legal or regulatory impacts to TAYGLE.

You give us certain legal permissions, or license to use content that you share or upload, such as photos or videos, which might be protected intellectual property laws. This means that when you put content on TAYGLE that’s covered by intellectual property rights, you give us a royalty-free, transferable, non-exclusive, sub-licensable, and worldwide license to display, use, run, copy, host, distribute, publicly perform, translate, and create derivative works of your content. This license will end when your content is deleted from TAYGLE. You retain ownership of the intellectual property rights, such as copyright or trademarks of content that you share or upload on TAYGLE, such as photos or videos.

You can delete individual content that you share, post, and upload. All content posted to your personal account is deleted if you delete your account except your content that has been used by others under these terms and those others have not deleted it. Deletion could take longer than 90 days and the license will continue until it is deleted under various situations including if there are technical issues or if it restricts our ability to investigate illegal activity or violations of our terms or to protect the safety, integrity, and security of TAYGLE, its employees and contractors, and users and to defend ourselves or it we would otherwise be restricted from complying with legal obligations for saving evidence or any record keeping required by law, or complying with a request of a judicial or administrative authority, law enforcement or government agency. Ads and content like this can be seen only by people who have your permission to view your actions on TAYGLE.

You provide TAYGLE with permission to use your name and profile photo and information about your actions on TAYGLE next to or in connection with ads, offers, and other sponsored or commercial content that we display without compensation to you.

You give us permission to download and install updates to our software if you download and use our software.

TAYGLE retains all rights to content protected by intellectual property rights that we have and make available such as images, videos, sounds or designs that you add to content that you create or share on TAYGLE. You can use our copyrights or trademarks only with our prior written permission.

You must get our written permission to modify, translate, create derivative works of, decompile, or reverse engineer our products or their components, or otherwise attempt to extract source code from us, unless an exception or limitation applies under applicable law.

As we improve TAYGLE and create new features, we might need to update these terms of service on occasion. We will notify you prior to updating our terms of service.

If we conclude, in our discretion, that you have breached our terms of service, we may suspend or permanently disable your access to TAYGLE, and we may permanently disable or delete your account. We may also disable or delete your account if you repeatedly infringe other people’s intellectual property rights or where we are required to do so for legal reasons.

We may disable or delete your account after registration if your account is not confirmed, is unused and remains inactive for an extended period of time, or if we detect someone may have used it without your permission and we are unable to confirm that the account is yours.

Where we take such action we’ll let you know and explain any options you have to request a review, unless doing so might expose us or others to legal liability; hurt users; compromise or interfere with the integrity or operation of any of our services; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons.

TAYGLE is provided "as is," and we make no guarantees that TAYGLE always will be safe, secure, or error-free, or that TAYGLE will function without disruptions, delays, or imperfections. To the extent permitted by law, we also DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content they share including offensive, inappropriate, obscene, unlawful, and other objectionable content.

We cannot predict when issues might arise with TAYGLE. Accordingly, our liability shall be limited to the fullest extent permitted by applicable law, and under no circumstance will we be liable to you for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these terms of service or TAYGLE (however caused and on any theory of liability, including negligence), even if we have been advised of the possibility of such damages. Our aggregate liability arising out of or relating to these terms of service or TAYGLE will not exceed the greater of $100 or the amount you have paid us in the past twelve months.

You and TAYGLE each agree that any claim, cause of action, or dispute between us regarding these terms of service or your access or use of TAYGLE shall be resolved exclusively in the U.S. District Court for the Northern District of California or a state court located in San Mateo County or Marin County. You also agree to submit to the personal jurisdiction of one of these courts for the purpose of litigating any such claim, and that the laws of the State of California will govern these terms of service and any claim, cause of action, or dispute without regard to conflict of law provisions. Without prejudice to the foregoing, you agree that, in its sole discretion, TAYGLE may bring any claim, cause of action, or dispute we have against you in any competent court in the country in which you reside that has jurisdiction over the claim.

These terms of service make up the entire agreement between you and TAYGLE regarding your use of TAYGLE. They supersede any prior agreements.

TAYGLE either already offers or may at some point in time offer additional services that are also or will be governed by supplemental terms. If you use any of those additional services, supplemental terms will be made available and will become part of our agreement with you. For example, if you access or use TAYGLE for commercial or business purposes, such as buying ads, selling products, developing apps, managing a group or page for your business, or using our measurement services, you must agree to our commerce terms. If you post or share content containing music, you must comply with our guidelines for music. To the extent any supplemental terms conflict with these terms of service, the supplemental terms shall govern to the extent of the conflict.

If any portion of these terms of service is found to be unenforceable, the unenforceable portion will be deemed amended to the minimum extent necessary to make it enforceable, and if it can’t be made enforceable, then it will be severed and the remaining portion will remain in full force and effect. If we fail to enforce any of these terms of service, it will not be considered a waiver. Any amendment to or waiver of these terms of service must be made in writing and signed by us.

You may not transfer any of your rights or obligations under these terms of service to anyone else without our consent.

You may designate a person to manage your account in the event you are no longer able or available to manage it. Only the person you designate to manage your account or a person who you identified in your will or similar legal document that has your consent to disclose your content to that person upon death or incapacity will be able to seek limited disclosure of information from your account.

These terms of service do not confer any third-party beneficiary rights. All of our rights and obligations under these terms of service are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

We may need to change the username for your account in certain circumstances. For example, if someone else claims the username and it appears unrelated to the name you use in everyday life.

We may use feedback and other suggestions about TAYGLE without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential.

We reserve all rights not expressly granted to you.
